Division of Planning

Objective

To provide expertise and services in planning, budgeting, implementation, monitoring and evaluation

Planning Section

The Section performs the following activities:

  • To prepare and submit bi-annual report to the Minister;
  • To coordinate preparations and implementation of office plans and budgets;
  • To facilitate the provision of services by Private Sector ;
  • To prepare contributions to Ministerial budget speech and annual economic report ;
  • To institutionalize strategic planning and budget skills ;
  • To carry out monitoring and evaluation of the office plans and budgets and prepare performance report ;
  • To asses and evaluate office plans and provide a basis for making informed decision on the future direction ;
  • To carry out research, assessments and evaluation of office plans and provide a basis for making informed decisions on the future direction;
  • To integrate office plans and budget into the government budgeting process; and ensure that office plans and budgets are integrated into the government budgeting process;
  • To coordinate preparation, resource mobilization and implementation of development projects/programs and evaluation process;
  • Undertake research and impact assessment studies of plans, projects and programs;
  • Undertake service delivery surveys to collect stakeholders/clients views and opinions on services rendered; and
  • Coordinate mid-year and annual performance review..
  • This Section will be led by a Principal Economic/Planning Office


Legislative Drafting Division

Objective Of this Division

To provide expertise and services on legislative drafting, translation and law revision.

Functions

The Division will perform the following functions:-

To advice Ministries, Independent Departments, Agencies and other Government institution and organizations on legislative process;

To receive from Ministers or Permanent Secretaries draft instructions based on Cabinet decisions and work on the instructions as required;

To receive and advice on legislative calendar for each for each ministry for each financial year;

To draft legislative proposal into Bills for enactment into law

To draft proposed subsidiary for gazettement or other purposes as required by law;

To revise legislation;

To draft all legislative instrument and resolution for ratification by the National Assembly; and

To prepare and submit bi-annual report to the Attorney General for on wards transmission to the Minister.

The Division will be led by a Chief Parliamentary Draftsman and will comprise of three (3) Sections as follows:

(i) Legislative Drafting Section

The Section will perform the following activities:-

Study proposal and consult Ministries, Independent Departments, Executive Agencies, Public and other government institutions which requires to undertake legislative measures

Coordinate research on relevant legislation and propose consequential amendments;

Advice the Chairman of the Legislative Committees of the Parliament in respect of legislative drafting issues;

Support the Minister and Attorney General in the presentations of new laws and amendments in the Cabinet and Parliament;

Draft and vet documents such as affidavits;

Prepare all legislative documents to be submitted to the Government Printer for publication; and

Oversee printing and distribution of legislative instruments.

The Section is be led by an Assistant Chief Parliamentary Draftsman.

(ii) Law Translation Section

The Section will perform the following activities:-

  • Translate principal and subsidiary legislative
  • Translation, resolution and other legal documents; and
  • Prepare and implement the law translation program for each financial year and accordingly advice the Chief Parliamentary Draftsman.

The Section is be led by an Assistant Chief Parliamentary Draftsman Law Revision Section.

(iii)Law Revision Section

The Section will perform the following activities:-

  • Revise laws and assign chapters to enactment of the Parliament;
  • Prepare revised edition of the laws of Tanzania at a given intervals of time;.
  • Incorporate and consolidate all principal and subsidiary legislation;
  • Codify and index legislation's;
  • Facilitate publication of legal documents;and
  • Prepare and implement the law revision program for each financial year and accordingly advise the Chief Parliamentary Draftsman.

The Section is led by an Assistant Chief Parliamentary Draftsman.


Division of Contract and Treaties

Objective

To provide expertise and services on treaties and contracts on behalf of the Government

Functions

The Division performs the following functions:

  1. Prepare and advise on Treaties, Contracts, Memorandum of Understanding and other business memorandum involving the Government.
  2. Provide legal advice to the Government in relation to Regional, bilateral and multilateral treaties.
  3. Provide legal advice to the Government in negotiation of major contracts involving the Government or other contracts to which the Government has an interest.

This Division is led a Director and comprise of two sections as follows:

Treaties Section

The section performs the following activities:

  1. Review and provide legal advice on regional, bilateral and multilateral treaties involving the Government or to which the Government has an interest.
  2. Provide legal advice to the Government in Treaties, negotiation and other Treaty matters.
  3. Provide legal advice to the Government on the activities of UN agencies, AU, SADC, EAC, commissions and other international organizations that require submission of a country position.
  4. Conduct research on international treaty matters.
  5. Provide legal consultation to MDAs, LGAs and the general public on treaty matters.
  6. Advice Ministries on treaties that require ratification by the National Assembly.
  7. Advice Ministries and independent departments on implementation of Treaties.

The Section is led by an Assistant Director.

Contracts Section

The section performs the following activities:

  1. Provide legal advice in the preparation of Contracts, Memorandum of Understanding and other business memorandum involving the Government.
  2. Provide legal advice in negotiation of all major Contracts and other legal documents to which the Government is a party or to which it has interest.
  3. Provide legal consultation to MDAs and LGAs on contracts to which the Government has interest;Conduct research on Government contract matters.
  4. Advice MDAs and LGAs on Contracts that require ratification by the National Assembly.Advise MDAs and LGAs on implementation of contracts to which Government is a party or to which the Government has interest.
  5. Vet and advise on procurement Agreements/Contracts.Prepare legal Opinion where they are a condition precedent for effectiveness of Loan Agreements from Multilateral Financial Institutions.Advise Consolidated Holding Corporation (CHC) on privatization of companies under it.Advise on all Government contracts before they are signed.

Division of Co-ordination and Advisory

Division of Co-ordination and Advisory

Administration and Human Resources Management Division

objective

.To provide expertise and services on human resources management and administrative matters to the Office

The Division performs the following functions:-

  • To Advice the Deputy Attorney General on administrative and human resources matters;
  • To provide strategic inputs to management on administration and human resources management issues such as recruitment, human resource development and training, promotion , retention, motivation performance management and welfare;
  • To process terminal benefits and leave;
  • To ensure optimal efficient and effective management and utilization of human resources and the office;
  • To link between the OAG and the Public Service Management and Employment Policy and laws governing public service;
  • To provide data support and up-date records on various human resources information;and
  • To collect, analyse, store and disseminate data and information related to human resources development plans.

The Division is led by Director and is comprised of two (2) Sections as follows:-

Administration Section

.The Section will perform the following activities:-

  • Interpret and enforce principal legislation governing the Public Service including regulations; standing orders and other labor laws, circulars and guidelines;
  • Facilitate employees relations and welfare including health, safety, sports and culture;
  • Provide registry, office records, messenger and courier services;
  • Handle protocol matters;
  • Facilitate provision of security services, transport and general utilities;
  • Facilitate general custodian services including maintenance of office equipment, buildings and grounds;
  • Coordinate implementation of ethics and value promotion activities including prevention of corruption practices;
  • Implement diversity issues including gender, disability, HIV/AIDS and Non- Communicable Diseases and be the Office's Gender Focal Point;
  • Administer the implementation of Business Process Improvement;
  • Advise on organizational efficiency of the Office;
  • Administer the implementation of Client Service Charter;
  • Administer implementation of Private Sector Participation;
  • Carry out any other duties as may be assigned by the Director;
  • Carry out impact assessment of the training programs and prepare assessment reports;
  • Coordinate the preparation and implementation of the Wage Bill and Recruitment; and
  • Initiate and co-ordinate in- house courses and on the job training.

Human Resource Management Section

.The Section performs the following activities:-

  • Coordinate staff recruitment, selections, placements, confirmations and transfers.
  • Facilitate Human resource training and career development (professional development, skills enhancement performance improvement, pre-retirement, part-time, and overseas).
  • Facilitate orientation/induction program for the new entrants;
  • Carry out human resources planning to determine supply and demand needs for professional.
  • Administer Salaries and process payrolls.
  • Process and update records of various leaves such as annual, sick, maternity, study and terminal.
  • Oversee employees benefits (pension, allowances etc) and entitlements.
  • Serve as a Secretariat to the employment Committee.
  • Coordinate implementation of Open Performance Review and Appraisal System (OPRAS), assess the appraisal results, prepare implementation reports, and make follow-ups on the implementation of the recommendations on individual OPRAS forms.
  • Prepare Annual Personnel Emolument Estimates.
  • Prepare and facilitate implementation of succession plans.
  • Carry out training needs assessment for the office and prepare training programs.
  • Monitor and evaluate implementation of institutional training programs and prepare training reports.
  • Carry out impact assessment of the training programs and prepare assessment reports; and
  • Initiate and co-ordinate in –house courses and on the job training.
